These website terms (the “Terms”) tell you the terms on which you make use of the www.HasanaH.org website (the “Website”).

1. Acceptance of these Terms
1.1 The Website is operated by HasanaH (charitable company limited by guarantee registered in England and Wales under registration number 11269974) (“HasanaH”, ”our”, “we” or “us”). Any use of the Website (including registrations and donations made via the Website) is subject to these Terms.
1.2 BY ACCESSING OR USING THE WEBSITE YOU CONFIRM THAT: : (i) YOU ACCEPT THESE TERMS AND YOU AGREE TO COMPLY WITH THEM; (ii) YOU ARE NOT NAMED OR INCLUDED IN THE CONSOLIDATED UNITED NATIONS SECURITY COUNCIL SANCTIONS LIST OR ANY OTHER INTERNATIONAL SANCTION LIST; AND (iii) THERE ARE NO PROCEEDINGS AGAINST YOU (ONGOING OR INITIATED IN THE PAST) FOR VIOLATION ANY FINANCIAL CRIMES INCLUDING IN RELATION TO PREVENTION OF MONEY LAUNDERING AND TERRORIST FINANCING. We recommend that you print off a copy of these Terms for future reference.
1.3 If you do not wish to be bound by these Terms then you must not use the Website.
1.4 We may, at our sole discretion, modify or revise these Terms at any time without notice by updating the text of this page. Please check this page for updates regularly.
2. Use of the HasanaH Website
2.1 The Website provides opportunities for you to make charitable donations online to HasanaH (“Donations”) with those Donations being used to support a variety of non-profit organisations (“Nonprofits”) and charitable projects around the world (“Projects”). The Website provides further information about HasanaH, and the Projects and Nonprofits which are featured on this site.
2.2 Anyone is entitled to view any non-password protected parts of the Website and to use for their own purposes the information contained therein, provided:
2.2.1 It is used for information purposes only, for reproduction for personal use only and not for reproduction on any other website or for commercial gain; and
2.2.2 No part of the Website is copied, stored in a retrieval system, or transmitted in any form or by any means to any third party without the permission of HasanaH.
2.3 If you reproduce or copy our Website in breach of these Terms, your right to use our Website will cease immediately, and you must, at our discretion, return or destroy any copies.
3. Making a Donation via the Website
3.1 Although the general information on the Website is suitable for users of any age, you must be over 18 years old to make a Donation via the website and to use the payment methods displayed on the Website.
3.2 To make a Donation via the Website you will need to follow the procedures set out on the Website.
3.3 Details of the procedures for payment and how we will process your donations are displayed on the Website.
3.4 Any times or dates stated in relation to the processing of your Donations are estimates only. We will make all reasonable efforts to comply with the times specified, but we do not accept liability for any failure to deliver within that time.
3.5 You may pay by credit or debit card or by using PayPal. You can also send Donations to HasanaH by sending cheques made payable to “HasanaH” to HasanaH Org, 4 Old Park Ln, Mayfair, London W1K 1QW, UK
3.6 We try to ensure that the information on the Website about Nonprofits, Projects, their funding goals and the amounts which they have received to date is accurate, but sometimes there may be a delay in updating this information, or funding goals for a Project may change from time to time.
3.7 When you make a Donation via the Website, you are making a Donation directly to HasanaH. HasanaH distributes the Donations it receives to Nonprofits around the world. HasanaH carries out detailed due diligence into the Nonprofits and Projects that it supports to make sure that the Donations are used to further charitable activities.
3.8 When you make a Donation via the Website you can indicate which Project and/or Nonprofit you would like to support. We will endeavor to distribute Donations in accordance with your preferences but note that there may be some rare occasions where HasanaH has determined (in its sole discretion) that a Project and/or Nonprofit has become ineligible for funding. If this happens we may contact you to ask your preference for an alternative Project or Nonprofit to reallocate your Donation to. Please note that we would not refund a Donation in the event it is not possible for HasanaH to distribute your Donation in line with your original preference and HasanaH reserves the right to distribute your Donation to other Projects and/or Nonprofits in our absolute discretion.
3.9 For every Donation that you make via the Website, HasanaH may, at its sole discretion, retain up to 12% of the value of each Donation and any relevant Gift Aid reclaimed to cover HasanaH’s operating costs and support HasanaH’s charitable activities. You can find further information in relation to this on the Website.
3.10 We are entitled to refuse to accept any Donation placed by you. If your Donation is accepted, we will confirm acceptance to you by emailing the email address you give us when you register on the Website.
3.11 You undertake that all details you provide to us for the purpose of registering an account and/or making Donations via the Website will be correct, that the credit or debit card, or any electronic cash, which you use is your own and that there are sufficient funds or credit facilities to cover any Donation you make. We reserve the right to obtain validation of your credit or debit card details or verification of the authenticity and ownership of these payment methods before taking any other steps to process your Donation.
3.12 HasanaH follows the UK Fundraising Regulator’s Code of Fundraising Practice www.fundraisingregulator.org.uk/code. If you raise any funds for the purpose of making Donations via the Website, you will ensure that any fundraising activity you undertake is done in accordance with the Code of Fundraising Practice.
4. Gift Aid and Refunds
4.1 When you make a Donation via the Website, your Donation is made to HasanaH (charitable company limited by guarantee registered in England and Wales under registration number 11269974). We will endeavor to distribute the Donations you make via the Website to your chosen Projects (subject to our rights set out in clause 3 above to distribute donations to other Projects and/or Nonprofits in our absolute discretion).
4.2 Once we have sent you the email confirming your Donation, it is not possible for your Donation to be refunded.
4.3 We do not provide accounting, tax or financial advice and you should not rely on any information given on the Website to determine the accounting, tax or financial consequences of making a Donation using the Website.
4.4 If you are a UK tax payer, HasanaH may be able to claim Gift Aid on the Donations you make to HasanaH via the Website. For HasanaH to be able to claim Gift Aid on your Donations, you will need to complete a Gift Aid declaration and you will be asked whether you want to make a Gift Aid declaration when you make a Donation on the Website. For your Donations to be eligible for Gift Aid, you will have to pay sufficient tax to cover the amount of Gift Aid claimed on your Donations made via the Website and any other donations that you make in that tax year.
4.5 We reserve the right to recover from you any funds we are required to repay to HM Revenue and Customs for any reason in connection with Gift Aid claimed on your Donations, including any infringement of applicable rules relating to Gift Aid. 5. Materials and Changes to the Website
5.1 The Website is intended to provide general information only and, as such, should not be considered as a substitute for advice covering any specific situation. Users should seek appropriate advice before taking or refraining from taking any action in reliance on any material or content contained in the Website.
5.2 Whilst we have taken every precaution in compiling the Website neither we nor any contributors to the Website can be held responsible for any action (or lack thereof) taken by any person or organisation wherever they shall be based, as a result, direct or otherwise, of material contained in or accessed through the Website.
6. Information you provide to us
6.1 When uploading content to the Website (including, but not limited to, any messages, emails, bulletin boards postings, ideas, photographs, suggestions, concepts or other material uploaded by you) you must:
6.1.1 ensure that the content that you upload is accurate and up to date;
6.1.2 not upload any content that is offensive, defamatory or likely to deceive any person;
6.1.3 ensure that you have all necessary permissions and the right to use the content and not upload anything that may infringe the copyright, database right or trade mark of any other person; and
6.1.4 ensure that the content does not advertise or otherwise solicit for funds and is not a solicitation for goods or services (other than encouraging other users of the website to make donations via the Website).
6.2 We reserve the right to alter or remove any content that you upload to the Website, without notice to you, if in our opinion it does not comply with these Terms.
6.3 We will not be responsible, or liable to any person, for the content or accuracy of any content posted by you or any other user of the Website.
6.4 If you breach these Terms then your permission to use the Website terminates immediately. We retain the right to deny any person access to the Website when we reasonably believe they have failed to comply with these Terms.
7. Your account and password
7.1 If you choose, or you are provided with, a username and password, or any other piece of information as part of our registration procedures, you must treat such information as confidential. You must not disclose it to any third party.
7.2 We have the right to disable any username or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions in these Terms.
7.3 If you know or suspect that anyone other than you knows your username or password, you should promptly notify us at [email protected] and we recommend that you change your password immediately.
8. Encryption and Viruses
8.1 Although the Website uses encryption security software in areas where on line payment details are accepted, the security of information and payments transmitted via the Internet cannot be guaranteed. We will do all we reasonably can to protect the Website and all internet communications passing between us and you, but any loss incurred or sustained by any user of the Website who transmits information by means of e-mail or other Internet links shall be borne solely and exclusively by such user and in no event shall any such loss in whole or part be borne by HasanaH or its agents. If you become aware of fraudulent use or your card, or if it is lost or stolen, you should notify your card issuer.
8.2 Whilst HasanaH makes all reasonable attempts to exclude viruses from the Website it cannot ensure such exclusion and no liability is accepted for damage caused through the downloading of viruses. Therefore we recommend that you take all appropriate safeguards before downloading information from the Website and have your own virus software in place.
8.3 You must not misuse our site by knowingly introducing viruses or other malicious material or attempt to gain unlawful access to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Website will cease immediately.
9. Applicability of Online Materials
9.1 Unless otherwise specified all content and materials published on our website are presented solely for your private, personal and non-commercial use.
9.2 Where content published on the website is supplied by third parties, you understand that we do not control or endorse such content in any way and we do not (to the extent permitted by law) accept responsibility for the accuracy or otherwise of such content (whether published on or offline) and/or the use of such content.

Those who visit the Website from locations outside of the UK do so on their own initiative and are responsible for compliance with all applicable local laws. 9.4 HasanaH makes no representations and gives no warranties, express or implied that making Donations via the Website is permitted under any applicable non-UK laws or regulations. You accept that if you are resident outside the UK, you must satisfy yourself that you are lawfully able to make Donations via the Website.
10. Copyright and Monitoring
10.1 Copyright in the material and content on the Website is owned by HasanaH or its content suppliers. Unauthorised use of any materials or content on the Website including reproduction, storage, modification, distribution or republication without our prior written consent or, where applicable, the respective copyright owner(s) is prohibited.
10.2 The names and logos of HasanaH and all related product and service names, designs, marks and slogans are the trade names, service marks or trade marks of HasanaH and may not be used without HasanaH’s prior consent.
10.3 All works in the nature of databases attract database rights.
11. Third Party Websites
HasanaH makes no representations whatsoever about any other websites which are operated by parties other by HasanaH and which you may access through the Website or which may link to the Website. HasanaH does not control such websites and we are not responsible for the content or availability of that website. Inclusion of links to another website does not mean that we endorse or accept any responsibility for the content, or the use of, such a website and we shall not be liable for any loss or damage that may arise from your use of them. The User is solely responsible for evaluating the accuracy and completeness of any information contained on the third party websites, and also the value and integrity of any goods and services offered by such websites.
12. Availability
We will make reasonable efforts to ensure that access to the Website is readily available but cannot guarantee that the Website will operate continuously or without interruptions or be error free. We may suspend, withdraw, discontinue or change all or any part of our Website without notice. We will not be liable to you if for any reason our Website is unavailable at any time or for any period. 13. Liability
13.1 Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
13.2 To the extent permitted by law we exclude all conditions, warranties, representations or other terms whatsoever which may apply to the Website or any content or information provided through the Website, whether express or implied.
13.3 We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising in connection with:
13.3.1 use of, or inability to use, the Website; or
13.3.2 use of or reliance on any content displayed on the Website.
13.4</If you are a business user, please note that in particular, we will not be liable for
(i) loss of profits, sales, business, or revenue,
(ii) business interruption,
(iii) loss of anticipated savings,
(iv) loss of business opportunity, goodwill or reputation; or
(v) any indirect or consequential loss or damage.
13.5 Subject clause 13.1, if we are found to be liable to you for any reason, our liability will be limited to the amount of any Donation you have made via the Website.
14. Force majeure
HasanaH shall not be held to be in breach of its obligations hereunder nor liable to any user of the Website for any loss or damage which may be suffered by another party due to any cause beyond its reasonable control including (without limitation) any act of God, fire, storm, flood, lightning, epidemic, pandemic, disease, strike, trade dispute, act of terrorism, any act or omission of government or regulatory bodies or communications operators.
15. General
15.1 If any provisions of these Terms are held to be invalid or unenforceable, the validity of enforceability of the remaining provisions shall not be affected
15.2 These Terms and the Privacy Policy constitute the entire agreement between HasanaH and you and supersede all other (prior or contemporaneous) communications and proposals, whether electronic or written, between you and HasanaH.
15.3 Any failure of HasanaH to exercise or enforce any of its rights under these terms and conditions shall not be deemed to be a waiver of any such rights or operate as to bar the subsequent exercise or enforcement of any such rights.
16. Jurisdiction
These Terms and your use of the Website shall be governed by the laws of England and Wales and the parties hereto submit to the exclusive jurisdiction of the English courts in all disputes arising out of or relating to the Website and/or any transactions made on the Website, or these Terms.
